The defendant requested the motion after claiming the State did not honor her right to remain silent nor provide appropriate Miranda warnings.According to the motion filed Monday, “The State never effectively stopped asking questions of the Defendant after she unequivocally communicated her right to remain silent not did the State provide an additional advisement and waiver of her Miranda rights.”Based on the court ruling and the timing of it, the prosecution asked for a continuance of the trial so a possible appeal could be explored and further evaluation of the case, Ripley County Prosecutor Ric Hertel explained.last_img
